Donation Payment Terms and Conditions
The Nelson Mandela Children’s Fund (referred to as NMCF, us or we) is Registered Non-Profit Organisation registered in South Africa (Registration No: 004-638). We operate the website www.nelsonmandelachildrensfund.com (the Website).
These are the Terms and Conditions which govern each use you make of the donation payment services provided through the Website.
These Terms and Conditions apply separately to each single donation that you make. Except as provided for in section 6, ‘Monthly Donations’, and unless specified by you, they do not form a contract allowing for future or successive transactions to be set up. By confirming on the Website that you wish to make a donation you agree to be bound by these Terms and Conditions for that donation.
Acceptance of any contribution, gift or grant is at the discretion of the The Nelson Mandela Childrens Fund. The The Nelson Mandela Childrens Fund will not accept any gift unless it can be used or expended consistently with the purpose and mission of the The Nelson Mandela Childrens Fund.
[1] The donation services
- We will use your donation at our discretion but within our stated programmes objectives.
- All payments through the Website are to be made by Electronic Fund Transfer, card payment or via selected Third Party Partners such as PayFast or PayPal.
- Once you confirm to us through the Website that you wish to proceed with your donation your transaction will be processed through our selected payment services provider(s). By confirming that you wish to proceed with your donation you authorize the Third Party Provider(s) to request funds from your credit, debit, or PayFast or PayPal card provider.
No irrevocable gift, whether outright or life-income in character, will be accepted if under any reasonable set of circumstances the gift would jeopardize the donor’s financial security.
The The Nelson Mandela Childrens Fund will refrain from providing advice about the tax or other treatment of gifts and will encourage donors to seek guidance from their own professional advisers to assist them in the process of making their donation.
The The Nelson Mandela Childrens Fund will accept donations of cash or publicly traded securities. Gifts of in-kind services will be accepted at the discretion of the The Nelson Mandela Childrens Fund.
Certain other gifts, real property, personal property, in-kind gifts, non-liquid securities, and contributions whose sources are not transparent or whose use is restricted in some manner, must be reviewed prior to acceptance due to the special obligations raised or liabilities they may pose for The Nelson Mandela Childrens Fund.
The The Nelson Mandela Childrens Fund will provide acknowledgments to donors meeting tax requirements for property received by the NMMCF as a gift. However, except for gifts of cash and publicly traded securities, no value shall be ascribed to any receipt or other form of substantiation of a donation / gift received by The Nelson Mandela Childrens Fund.
[2] Unauthorised card use
- If you become aware of fraudulent use of your card, or if it is lost or stolen, you MUST notify your card provider and also make our offices aware at finance@nmcf.co.za.
[3] Information from you
Before we can process a donation you must provide us with:
- your name, address and email address; and
- details of the credit or debit card that you wish to use to fund the donation on the secure Third Party portal.
We will use this information to process your donation. It is your responsibility to ensure you have provided us with the correct information.
When you submit your payment details, these details will be transferred to the relevant Third Party payment provider and your payment data will be collected and processed securely by them.
You should make sure that you are aware of the Third Party terms and conditions, which are different from the NMCF, to ensure that you are comfortable with how they will process your personal data before you make a donation.
We will never share your personal details with any other Third Party other than is set out in our Privacy Policy. Our Privacy Policy forms part of these Donation Payment Terms and Conditions and by agreeing to these Terms and Conditions you are also agreeing to the way we use and protect your personal information in line with our Privacy Policy.
The The Nelson Mandela Childrens Fund will respect the intent of the donor relating to donations / gifts for restricted purposes and those relating to the desire to remain anonymous. With respect to anonymous gifts, the The Nelson Mandela Childrens Fund will restrict information about the donor to only those staff members with a need to know.
[4] Refund policy
If you make an error in your donation please contact us either by email at finance@nmcf.co.za or via telephone at +27 (0) 11 274 5600 – if the claim is valid, a full refund will be made within 14 days to you.
The The Nelson Mandela Childrens Fund will not compensate, whether through commissions, finders' fees, or other means, any third party for directing a gift or a donor to the The Nelson Mandela Childrens Fund.
[5] Monthly donations
These Donation Payment Terms and Conditions will only apply to successive donations made through the Website where you have set up a monthly donation.
When you set up a regular donation you will be scheduling a series of donations to be made on the day of the month that you choose until further notice. You agree that these Terms and Conditions will apply to each of the donations in that series.
By confirming that you wish to proceed with a monthly donation you authorize our preferred Third Party payment service provider(s) to request funds from your credit or debit card on the day of each month that you set.
To cancel your regular donation please contact us at finance@nmcf.co.za.
[6] General
The NMCF reserves the right to amend these Donation Payment Terms and Conditions at any time.
These Donation Payment Terms and Conditions are governed by South African law and are subject to the exclusive jurisdiction of the South African courts.
